After a three-day jury trial, Murnane Brandt’s Anissa Mediger successfully secured a defense verdict in a unique invasion of privacy matter involving a photography company. In two separate claims that were consolidated for trial, plaintiffs alleged that Murnane’s client invaded their privacy by publishing photographs of the pair on the company’s secure online photo gallery.
In defending the case, Anissa argued that the photo company did not invade the plaintiffs’ privacy because there was no “reasonable expectation of privacy” in the photos at issue. Each individual photographed was advised that all photographs taken during the event would be placed on a secure online gallery. The case was tried in Hennepin County. After deliberating for 90 minutes, the jury found that the photographs were “not private” prior to disclosure and therefore, plaintiffs’ claims for invasion of privacy failed.
